    In my personal experience, this guy is a liar and a hypocrite. Even after being called out in public for being a liar he determined that continuing to be a liar was in his best interest. I suspect he would have sold us out to the Telecom industry for free just because that’s the way he rolls.

    Thank you for contacting me regarding your support for Net Neutrality. I appreciate you sharing your thoughts on this important issue.

    In 1996, former President Bill Clinton signed into law the bipartisan Telecommunications Act of 1996, which established the internet as free, open, and “unfettered by Federal or State regulations”. It was this legislation that classified the internet under the Title I, a light-touch regulatory framework that allowed the internet to become a true free market success story and increased internet access at cheaper prices that resulted in an explosion of web companies to serve the new market of consumers.

    For several years, the Title I regulatory framework was enforced by the Federal Trade Commission (FTC). Under the FTC, Internet Service Providers (ISPs) operated by establishing connection rates with their customers and treating all content providers the same. This principle became known as Net Neutrality.

    In 2015, President Obama demanded that the Federal Communications Commission (FCC) reclassify ISPs under Title II of the Telecommunications Act – which is a regulation established in the 1930s for telephones. The reclassification came about due to an unwarranted fear of ISPs blocking, speeding up, or slowing down internet content. This occurred despite the fact that the principle of Net Neutrality was respected by every party of the internet community, and was well monitored by the FTC. To date, no tangible evidence has ever been offered to justify the reclassification.

    When we think about ISPs, generally big corporations come to mind: Comcast, Verizon, AT&T, etc. You may be interested to know, however, there are 41,000 ISPs within the United States, normally with 500 customers or less and serving rural and low-income communities. Unfortunately, the Title II reclassification has frozen, and actually decreased, the number of ISPs.

    Because of higher compliance costs under the FCC, many rural and low-income communities are left without internet access. Small ISPs have gone out of business and bigger companies are disincentivized to serve these communities that have such high barriers for entry. Beyond that, rising compliance costs have reduced incentives for ISPs to innovate and provide consumers with better service, like a 5G network. In fact, it is estimated that this reclassification has already cost the country $5.1 billion in broadband capital investment in the two years it has been implemented.

    Furthermore, this reclassification created inconsistency in our privacy laws. Instead of implementing the FTCs rules for ISPs after the reclassification, which had been well-established for many years, the FCC created a more stringent regime that has generated an uneven playing field where different ISPs are subject to different rules by different regulators. This ruling has essentially created inconsistencies in privacy laws, the very ones that are there to protect you and me as internet consumers, and undermined future innovation within the internet provider sector all together.

    I, like FCC Chairman Pai, am committed to a free and open Internet, but even President Obama’s former FCC Chairman, Tom Wheeler, admitted Net Neutrality had always governed the Internet. Unfortunately, the onerous regulations of this reclassification have hindered broadband deployment and innovation.

    As such, I supported S.J.Res. 34, a resolution disapproving of the FCC inconsistent privacy regulations. Now the FCC must return ISPs to the Title I classification in order to fully restore the integrity of the internet.
